Unless exempt, employees covered by the Act must receive overtime pay for hours worked over 40 in a workweek at a rate not less than time and one-half their regular rates of pay. New proposed overtime regulations are set to take effect on December 1, 2016. Never has it been more pressing for employers to understand the exemption rules under FLSA. FLSA Employers continue to be challenged by employee lawsuits claiming unpaid overtime. The majority of these lawsuits are the result of claims that the employer wrongly classified its workers as exempt.
